These Terms of Service ("Terms") govern your use of the DevianCanvas NFT marketplace. Please read them carefully before using the Platform.
By accessing or using DevianCanvas ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use the Platform.
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use the Platform. By creating an account, you represent that you meet these requirements and that the information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. New accounts are subject to review and approval by our administrators. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
When you mint an NFT, you retain ownership of the underlying intellectual property rights to your content. You grant DevianCanvas a limited license to display your content on the Platform for the purpose of facilitating its sale and promotion. You warrant that you own or have the necessary rights to all content you upload, and that it does not infringe on the rights of any third party.
You agree not to mint, sell, or distribute content that is illegal, infringing, defamatory, hateful, pornographic, or otherwise objectionable. You may not use the Platform to launder money, commit fraud, manipulate prices, or engage in any activity that disrupts the integrity of the marketplace.
The Platform charges a mint fee for publishing NFTs and may charge transaction or withdrawal fees from time to time. All fees are clearly communicated before they are incurred. You are responsible for ensuring you have sufficient funds in your wallet for transactions.
Deposits and withdrawals are processed manually by our administrators after review. Proof of payment may be required. Transfers between users are processed instantly. DevianCanvas is not responsible for delays caused by external payment networks or for errors in payment information you provide.
Bids placed on the Platform are binding offers. Placing a bid is an instruction to purchase the NFT at your stated price if accepted. You should only bid amounts you are willing and able to pay.
The DevianCanvas name, logo, design, and all Platform materials are the exclusive property of DevianCanvas. Nothing in these terms grants you a right to use our trademarks or branding without prior written consent.
The Platform is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, DevianCanvas shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, from your use of the Platform.
We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these terms or pose a risk to the Platform or its community.
We may update these Terms of Service from time to time. Changes take effect immediately upon posting. Your continued use of the Platform after changes are posted constitutes acceptance of the revised terms.
These terms are governed by and construed in accordance with the laws of the jurisdiction in which DevianCanvas operates, without regard to conflict of law principles.
